Terms of Service for Etapik

1. Acceptance of Terms

By downloading, installing or using the Etapik mobile application (package com.arttic.etapik) on any device, you accept these Terms of Service. If you do not agree with any of these terms, do not use the application. Arttic S.A.S. reserves the right to modify these terms at any time. Material changes will be notified in the app before they take effect; if you do not accept them, you may delete your account under section 7.

2. Service Description

Etapik is a mobile application designed to support early childhood development. It allows adults (mothers, fathers, caregivers) to register child profiles, perform interactive activities, record developmental milestones, and save photos and videos of memories. The application operates primarily locally on the user's device, without syncing to central Etapik servers (except authentication).

3. Eligibility and Authorization

Etapik is designed to be used by responsible adults (mothers, fathers, guardians or caregivers). It is not directed to minors, and minors cannot create or manage accounts. By using Etapik, you declare that:

  • You are 18 years of age or older, or have the legal age required in your jurisdiction.
  • You are the legal representative of any minor whose data you register in the application.
  • You have authority to give consent regarding personal data of minors in your care.
  • You will comply with all applicable laws in your country of residence.

4. License to Use

Arttic S.A.S. grants you a personal, non-transferable, non-exclusive and revocable license to download, install and use Etapik on devices you own or control, solely for personal, non-commercial purposes. You may not:

  • Copy, modify, translate, adapt, hack or create derivative works of Etapik.
  • Sell, rent, lend or transfer the license to third parties.
  • Use Etapik to offer competing or similar services.
  • Reverse engineer, decompile or attempt to obtain source code of Etapik.
  • Bypass, disable or interfere with security measures or access controls.
  • Use Etapik for unlawful, fraudulent or harmful purposes.

5. Intellectual Property

Etapik, including its code, design, interface, content, graphic assets, name, logo and all features, are intellectual property of Arttic S.A.S. or its licensors. They are protected by copyright, trademark and other applicable laws. Use of Etapik does not grant you ownership or rights over these elements.

6. User Content — Photos and Videos

Etapik allows users to capture, record and save photos and videos of "Memories" associated with activities. You are responsible for:

  • Ensuring you have rights to capture and use any photos or videos you record (including image rights of persons appearing).
  • Ensuring the content does not violate copyright, trademarks or other intellectual property rights of third parties.
  • Not including indecent, defamatory, discriminatory, illegal or privacy-violating content.
  • Managing and backing up your files: Etapik stores locally on your device, not on central servers. If you change phones without backup, memories are lost.

Limitation of Liability: Since memories (photos and videos) are stored only on the user's device and not transmitted to Arttic servers, Arttic S.A.S. is not responsible for third-party rights infringements or inappropriate content in those files. You release Arttic from any claims related to photos or videos you capture, own and control.

7. Account Cancellation and Deletion

You may delete your Etapik account at any time from the application (Profile → Delete Account). This will permanently delete:

  • Your profile and those of all associated children.
  • All history of activities, milestones and streaks.
  • All memory records (metadata) and photo/video files stored in Etapik.

Note: memories you have already saved to your phone's camera roll remain under your control and are not affected.

8. Service Availability and Changes

Arttic S.A.S. strives to keep Etapik available and functioning without interruptions, but does not guarantee uninterrupted availability. Etapik may be subject to maintenance, updates or changes without prior notice. Arttic may discontinue features, versions of Etapik or the entire service at any time. Arttic will not be responsible for damages arising from unavailability, interruptions, data loss or service discontinuation.

9. Disclaimer of Warranties

ETAPIK IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. ARTTIC DOES NOT WARRANT THAT ETAPIK WILL OPERATE ERROR-FREE, WILL BE SECURE, WILL BE VIRUS-FREE OR UNINTERRUPTED, OR THAT RESULTS OR INFORMATION OBTAINED WILL BE ACCURATE OR RELIABLE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTTIC S.A.S. IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES (INCLUDING LOSS OF DATA, PROFITS OR SAVINGS), EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ARTTIC'S TOTAL LIABILITY FOR ANY CLAIM RELATED TO ETAPIK SHALL NOT EXCEED THE AMOUNT YOU PAID FOR ETAPIK IN THE LAST TWELVE MONTHS (OR ZERO IF YOU PAID NOTHING).

11. Indemnification

You agree to indemnify and hold harmless Arttic S.A.S., its directors, employees and agents from any claim, damage, loss, expense (including legal fees) arising from:

  • Your use of Etapik in violation of these terms.
  • Photos, videos or other content you capture, record or save in Etapik.
  • Breach of applicable data protection or minor privacy laws.
  • Violation of third-party intellectual property rights.

12. Dispute Resolution and Arbitration

Binding Arbitration Agreement: You and Arttic S.A.S. agree that any dispute, claim or controversy arising from or related to these Terms, the Privacy Policy, or the use of Etapik shall be resolved through binding arbitration, and not in a court of law.

  • Scope: This includes claims for breach of contract, tort, statute, fraud, negligence, strict liability, or any other legal basis, except:
  • Claims for intellectual property infringement if a party seeks injunctive relief.
  • Claims that are not subject to arbitration under applicable law.
  • Procedure: Arbitration shall be conducted in accordance with the rules of the International Chamber of Commerce (ICC) or, in Colombia, the rules of the Bogotá Chamber of Commerce. There shall be one arbitrator, unless the claim exceeds USD 250,000 (in which case there shall be three arbitrators).
  • Place: Arbitration shall take place in Bogotá, Colombia, or online (virtual) at the claimant's discretion.
  • Language: Proceedings shall be in Spanish or English, at the claimant's discretion.
  • Costs: Each party bears its own legal fees. Arbitrator costs are split equally, unless the arbitrator orders otherwise.

Waiver of Class Actions: You and Arttic agree that any arbitration proceeding shall be individual and not a class action, collective suit or group mediation. You waive the right to participate in a class proceeding.

Consumer Rights: Nothing in this section limits the rights that Colombian law grants to consumers, including the right to file complaints with the Superintendencia de Industria y Comercio.

Governing Law: These Terms and your relationship with Arttic shall be governed by the laws of the Republic of Colombia, without regard to conflicts of law principles.

13. Legal Compliance

Etapik complies with Colombian Law 1581 of 2012 on personal data protection. See the Data Protection and Privacy Policy at /en/etapik-privacy.html for details.

For users outside Colombia, Etapik also complies with equivalent minor data protection standards (GDPR in EU, COPPA in USA, etc.) to the extent applicable.

14. Suspension and Termination

Arttic may suspend or terminate your access to Etapik, without prior notice, if you:

  • Violate these Terms or the Privacy Policy.
  • Engage in unlawful, fraudulent or rights-violating activities.
  • Attempt to bypass security measures or perform attacks on Etapik.
  • For any other reason Arttic deems, in its sole discretion, inappropriate.

Upon termination, your right to use Etapik ceases immediately. You may delete your account in accordance with Section 7.

16. Final Provisions

If any section of these Terms is invalid or unenforceable, the remaining sections remain in effect. Arttic's failure to exercise a right under these Terms does not constitute a waiver of that right. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Arttic regarding Etapik.
